BE IT ACKNOWLEDGED, that ________________________ representing ____________________, of ________________________ ("Seller"), the undersigned deponent, being of legal age does hereby depose and say under oath as follows (and as may be contained on reverse side or signed addendum sheets):

 

WHEREAS, _____________________ of ____________________ ("Purchaser"), did purchase from the Seller a horizontal friction treatment, called "pHlurous Traction Treatment" (the initial application), which said pHlurous Traction Treatment has been independently tested and proven, upon proper application, to provide an acceptable coefficient of friction (above .50), as prescribed by Underwriters Laboratory ("UL") and OSHA standards, to prevent slip/falls; and

 

WHEREAS, the ongoing pHlurous Traction Treatment Cleaner (used after the initial application), when used as directed, has been found, through independent certified tests to maintain a "very safe" average range of (.70 to .87 and above) coefficient of friction under the said UL and OSHA standards ("acceptable coefficient of friction"); and

 

WHEREAS, upon review of the purchase by the Purchaser, Seller hereby declares and certifies that sufficient pHlurous Traction Treatment Cleaner was purchased by Purchaser to have enabled Purchaser to maintain an acceptable coefficient of friction on the horizontal surface in question, assuming it's application was in accordance with directions supplied by Seller;

 

NOW, THEREFORE: it is the Sellers position: 1) that an expert witness would be able to substantially duplicate the conditions present at the time of an accident; 2) that the pHlurous Traction Treatment Cleaner will produce an acceptable coefficient of friction, establishing probative value for the Purchaser; 3) That under the established case law of the various jurisdictions in the United States, a finding of an adequate coefficient of friction should be admitted as relevant evidence of the absence of negligence and should increase the Purchaser's  chance of avoiding liability for a slip fall accident; and 4) that Purchaser, as a reasonably prudent person(s), exercised due diligence when selecting pHlurous Traction Treatment and Cleaner as it's horizontal surface safety system and that there is a presumption from the volume of purchased material that the horizontal surface was maintained in a reasonably prudent manner without any evidence of negligence.

We, the manufacturers of pHluorurs®, guarantee that following the initial treatment, having been applied according to directions and maintained with the pHluorus® cleaner, your floor will continue to be slip-resistant for at least 10 years from date of application.  In the event that a slip/fall claim should arise, we will provide affidavits as supportive evidence that the floor was slip resistant

SLIP/SAFE FLOOR SAFETY TREATMENT

 

INITIAL TREATMENT DIRECTIONS

 

SLIP/SAFE has been formulated to comply with the exact requirements of your floor, eliminating the need for a specific dwell time.  The only requirement for extraction and neutralization of the chemical is that you start the process before the liquid starts drying on the floor.

After lightly spraying floor with water.

    STEP 1. Application:  Pour SLIP/SAFE into a mop bucket and mop directly on the floor.  Briskly broom the solution evenly while being careful not to splash solution on glass or aluminum surfaces.  All mopping should be done backwards so as to not leave mops, buckets, pails or brooms containing SLIP/SAFE on the floor.  If application area borders carpet, mop lengthwise along border, then squeegee away from carpet before extraction.

 

    STEP 2. Extraction:  Dry mop residue from floor and thoroughly rinse mop and bucket with clean water.  Fill bucket with clean water and mop on water and dry mop several times (changing mop water after each sequence).  Mopping is not necessary where floor drains exist.  Simply hose residue into drains with a pressure nozzle, brush with a push broom and repeat process until floor produces no more "cloudiness" in water.  Broom between all rinses.  After final rinse, squeegee all water into drains.

 

    STEP 3. Neutralization:  (This step is optional and only recommended where a temporary surface "chalkiness" is unacceptable due to appearance considerations)  Neutralization is partially accomplished from the water rinses; the more rinses, the more complete.  When dry, a slight chalkiness may appear temporarily depending upon floor surface composition. Complete neutralization will occur within a few weeks of repeated cleaning with SLIP/SAFE CLEANER.  Immediate neutralization can be accomplished with SLIP/SAFE NEUTRALIZER (N-7) which is applied similar to STEP 1.. The use of N-7 will slightly reduce the static coefficient of friction.

 

 

CAUTION:  CORROSIVE, CONTAINS MINERAL ACIDS

 

When using undiluted SLIP/SAFE for Initial Treatment (or any other product which gives off inorganic acid gases), always use an approved respirator during application.  Wear rubber boots and protective clothing.  Familiarize yourself with the precautions on the accompanying Material Safety Data Sheet.  Respirators and protective clothing are not required when using SLIP/SAFE CLEANER SOLUTION.  Manufacturer or seller makes no warranty, express or implied, concerning the use of this product other than for the purpose indicated in these directions.  Manufacturer or seller is not liable for any injury or damage caused by this product due to misuse, mishandling or any application not specifically described herein.

MANUFACTURERS DECLARATION AND WARRANTY

In the matter of Slip/Safe, Inc. technical report Tier 3000 series report "3020" it is hereby declared:

The "Treatment of Cement or Concrete Surfaces with pHluorus"

report, Professor of Chemistry, Robert W. Parry indicates that:

"It is known that Slip/Safe solution, when applied to a concrete or tile surface, increases the surface coefficient of friction of the cement or tile and renders it less "slippery".  The study reported here had three major goals.  These were:

1.To obtain experimental evidence which would define the chemical processes resulting from the treatment of a cement surface with Slip/Safe solution.

2.To determine whether treatment of a concrete surface with Slip/Safe solution alters the "compressive strength" or the "flexural strength" of the concrete in any way."

Enclosed are the original "Garco" testing laboratory reports.  Garco is a member of ASTM, ACI, AGC, National Laboratory Accreditation Program and United States Department of Commerce Accredited.  The results of those tests clearly indicated an increase on pHluorus treated samples both in "flexural and compressive" strength.

Under FAA and ICAO guidelines for pedestrian traffic horizontal surfaces, an acceptable coefficient of friction would be mandated under the OSHA General Safety Orders "Title 8" as applicable for areas regulated by the FAA and by treaty with the ICAO.  These agencies would follow guidelines set by the OSHA federal law.

"We, the manufacturers of Slip/Safe guarantee that following the initial treatment, having been applied according to directions and maintained with the Slip/Safe cleaner, your floor will continue to be slip-resistant for at least 10 years from date of application.  In the event that a slip/fall claim should arise, we will provide affidavits as supportive evidence that the floor was slip resistant."
